As per a report by the New Mexico Political Report, a jury in New Mexico's First Judicial District Court in Santa Fe found on September 25 that Meta willfully violated the state's Unfair Practices Act, tallying 43,899,720 separate violations across 26 public statements made between 2010 and 2021 by executives including Mark Zuckerberg and Sheryl Sandberg. The statements covered privacy, hate speech, misinformation and the company's handling of the Cambridge Analytica scandal, which alone accounted for more than 18.1 million of the violations tied to over 350,000 New Mexicans whose data was harvested.

With the state's law allowing up to $5,000 per violation, the jury's finding puts Meta's maximum exposure at roughly $219.5 billion, though a judge — not the jury — will set the actual penalty. New Mexico Attorney General Raúl Torrez called the verdict a landmark moment for holding Big Tech accountable for public statements about how it handles user data.
