As per a report by Bar & Bench, a bench of Justices Dipankar Datta and Augustine George Masih, in a judgment delivered on October 15 dismissing appeals against insolvency proceedings on two companies that run hotels in Bengaluru and Pune, criticised the advocate-on-record for the appellants. Verdictum reports that the appellants' compilation of case law contained non-existent decisions generated using artificial intelligence, and that the respondents objected immediately. The court recorded that the advocate-on-record "sought to shift the entire blame on the appellants while at the same time feigning ignorance of what the compilation contained," while senior counsel for the appellants took the blame on himself and prayed for forgiveness on their behalf.
The bench initially proposed exemplary costs but made no order as to costs after learning of the death of the first appellant, Deepak Raheja. The appeals, brought under the Insolvency and Bankruptcy Code against National Company Law Appellate Tribunal orders upholding the admission of insolvency petitions against GSTAAD Hotels and Neo Capricorn Plaza, were dismissed, and the insolvency process was allowed to proceed.
