As per a report by MediaNama, a bench of Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana heard a petition by Just Rights for Children Alliance on September 28 seeking binding safeguards for minors on social media. Justice Bagchi told the Union government that "guidelines are mere guidelines" and should instead be "in some statutory format," pressing for binding rules rather than voluntary industry codes.
In response, the government committed to amend the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules to make a bar on under-18 users creating social media accounts a statutory obligation for intermediaries, along with parental-consent requirements for certain educational platforms. The bench also directed the government to frame these obligations around Indian law rather than importing age-verification approaches built for other jurisdictions.
